Basis for processing ordinary personal data
According to the Dutch General Data Protection Regulation (AGV), MobiLED B.V. has a legal basis for processing ordinary personal data of purchasers. The data processing is necessary for the execution of an agreement, namely sending the ordered products and preparating and sending the invoice. They are also used to contact the purchaser with regard to shipping, order and / or information.
MobiLED holds data such as name, shipping and billing address, place of residence, country, telephone number, e-mail address and, if applicable, company name and VAT number. If the order has been paid by bank transfer or Ideal / Mollie, we also possess the bank account number.
Through a monthly newsletter, we inform interested people about news in the field of vehicle LED lighting, our products, installation tips, customer stories and other related matters. Through our website or via the link in the signature of our e-mails, interested parties can subscribe to our newsletter. Buyers receive the newsletter by default if they do not unsubscribe when placing the order.
By placing the order, the purchaser consents to the use of the personal data regardless of whether the order was placed via the website or not.
Refusal to provide personal data
If the purchaser is unwilling or unable to provide their personal data, the agreement with MobiLED can only be established if the purchaser collects the order and pays the invoice immediately. The order is entered into the system under the client account "customer counter". Due to the lack of the actual contact details, MobiLED cannot perform a recall or check the warranty period. As a result, warranty provision is only possible by visiting in person.
Passing on personal data to third parties
Personal data is passed on to carriers so that orders can be processed and delivered via the carrier's system. Personal data required for invoicing is processed in our accounting system.
The newsletter subscriber file is used in our newsletter tool and used exclusively for sending newsletters. It is not provided to third parties. The newsletter software logs when a newsletter is opened and which links are clicked on.
The agreements agreed upon with third parties state, among other things, that the personal data will only be processed in accordance with the applicable laws and regulations regarding personal data. And that the third party takes all possible care to ensure that the personal data are processed securely.
Retention period
Personal data will be kept for at least seven years after the expiry of the warranty period on the last ordered products. This period is determined by the legal retention period of seven years for the tax authorities.
The e-mail addresses for the newsletter are stored in our newsletter tool. If the recipient unsubscribes via the link in the newsletter, the recipient's details are archived.
Rights of data subjects
As stipulated by the AVG, purchasers may access, supplement, amend or delete their personal data. To this end, a request can be made via the general e-mail address: [email protected].
